Fmr Federal Prosecutor Says AOC ‘Skirting’ Legal Line Giving Advice to Illegals

A former federal prosecutor stated over the weekend that Rep. Alexandria Ocasio-Cortez (D-New York) and others who provide advice to illegal immigrants about how they can avoid being detained by Immigration and Customs Enforcement agents are “skirting the line” legally. This means that she could find herself in legal trouble if she continues to provide such advice.

Jonathan Fahey’s comments come after Tom Homan, the border czar for the Trump administration, issued multiple warnings to Alexandria Ocasio-Cortez (AOC) last week, stating that she may be in violation of federal law if she prevents Immigration and Customs Enforcement (ICE) officials from performing their duties.

In addition, Homan mentioned that he is currently in the process of requesting a legal opinion from the Department of Justice over the definition of “impediment,” which may be considered a criminal offense.

On Friday, during a story, Bryan Llenas, an anchor for Fox News, posed the question to Fahey, asking if Homan “has a point.”

In this case, he does have a point, but it’s more for the bigger picture than anything else. “You know, when you compare what he is doing, which is trying to get rid of the most serious criminals who are also illegal aliens, and what she is doing, which is fighting tooth and nail to keep them in here,” Fahey started out by saying.

A question: Is this an attempt to impede justice? Are these webinars intended to educate people in a genuine manner, or are they a sham designed to preserve the presence of illegal immigrants in the country?

Continuing, Fahey said. “And some of her words are extremely intriguing because she refers to illegal immigrants as regular Americans or something like that, as if they have the right to stay in this country without permission.

When she makes fun of Tom Homan, she is inaccurate in her interpretation of the law when she asserts that it is not a crime to be in this country illegally. He acknowledged that the majority of these individuals entered the country illegally, which is a criminal offense.

“The other thing that she is really skirting the line on is the federal harboring statute, which states that if you are doing anything to conceal, shield, or harbor illegal aliens from being deported or if you are encouraging illegal aliens or people you have reason to know are illegal aliens to reside in the country illegally,

you could be in violation of that as well,” he added. “Many of the sanctuary cities are also in violation of this statute.”

There is no doubt that she is getting very near to the line, and I am not sure that she has moved on from it. The fact that many of these sanctuary cities are not just over the line but have been over the line for the past five years is going to be the primary motivation for them to work together since they are already over the line.

Do you think the Department of Justice is going to take a look back at what they have been doing, or do you think they are going to comply and participate? According to Homan, “I believe that the majority of them will cooperate.”

His comments came after the congresswoman conducted a webinar in both English and Spanish, during which an attorney from the Immigrant Defense Project named Genia Blaser stated that “ICE raids are political tactics, and they are often intended to create fear.”

Blaser continued by warning viewers that ICE officials are “often very aggressive, and the encounters can happen really quickly.” He also stated that it is really important to have knowledge since knowledge is power. In addition, Blaser advised viewers that it is really vital to have knowledge.

Additionally, Ocasio-Cortez has posted a leaflet on her website that provides information regarding “their rights” for illegal immigrants.

A statement was made that stated, “You are not required to open the door” for officials of Immigration and Customs Enforcement.

Additionally, it informs them that ICE officials do not have the authority to enter the residence of a person if they do not possess a warrant that has been issued by a judge and is valid.

According to the leaflet, “You can ask them to slip the warrant under the door at your convenience.”

Furthermore, in order to prevent illegal immigrants from being deported, her agency is offering free legal assistance to such individuals.

On Thursday, Homan talked to Laura Ingraham, who is a host on Fox News. During their conversation, he made the suggestion that the representative might be subject to criminal prosecution for what she is doing.
